Participation in Environmental Protection from the Perspective of International Environmental Law and Domestic Laws of Afghanistan

Abstract

Undoubtedly, the environment plays a significant and vital role in the existence and survival of humanity. Consequently, environmental protection has become a serious concern for humans today. This research examines participation in environmental protection from the perspective of international environmental law and the legal system of Afghanistan. The authors of this study have employed a descriptive-analytical method and library-documentary sources to investigate this important issue. The findings of this research indicate that various approaches to participation in environmental protection have been envisaged from the perspective of international documents and the legal system of Afghanistan. These approaches include government participation in lawmaking, government participation in raising awareness, public participation in decision-making, government and public participation in environmental protection, support, and development, government participation in the transfer of science and technology, financial participation of developed countries in improving the environment in developing countries, public participation in seeking compensation and resorting to judicial authorities, and participation of public organizations and groups in environmental protection. International environmental law and the legal system of Afghanistan share many commonalities in these aspects, while also exhibiting differences in certain cases.
