Positive Obligations of Employers and Workers in Afghanistan's Labor Legislation

Abstract
The obligations outlined in internal work documents and employment contracts for both workers and employers require analysis and evaluation. These obligations play a fundamental role in clarifying mutual commitments and reducing disputes between the parties. The employer's obligations primarily encompass financial responsibilities, workplace conditions, occupational health and safety measures, and the provision of necessary work equipment. Conversely, the worker's duties include adherence to job regulations, performing work honestly and efficiently, improving productivity and quality, maintaining confidentiality, safeguarding the employer's assets, and complying with workplace safety regulations. These obligations are systematically analyzed in this study. In sum, the nature, foundations, classifications, and precise scope of these obligations have been examined using a library research methodology focused on legislative frameworks and a descriptive-analytical approach. This ensures the obligations of both the worker and employer are well-defined and transparent. The research aims to determine the essence, foundations, types, and exact scope of these commitments under Afghanistan's labor law. However, it must be acknowledged that the practical enforcement of these obligations—particularly those on the employer's side—faces challenges due to various social, economic, and cultural factors. Additionally, regulatory institutions tasked with overseeing compliance encounter significant obstacles.
