Abstract

The Responsibility Of States In Protecting And Preserving Human Rights During States Of Emergency Reflects A Profound Connection Between The Necessity Of Maintaining Public Order And The Fundamental Obligations Of Human Rights. Although Emergency Situations May Provide Grounds For Imposing Limitations On Certain Rights, This Does Not Imply The Complete Suspension Of The Human Rights System Or The Release Of States From Their Core Obligations. Within This Framework, The State, As The Holder Of Public Authority, Is Required To Exercise Its Power Within The Bounds Of Law And With Respect For Human Dignity, In Such A Way That Even In Times Of Crisis, The Fundamental Principles Of Human Rights Remain Respected. The Findings Of The Research Indicate That, In Addition To Legal And Moral Obligations, States Also Bear Specific Practical Responsibilities, Including The Protection Of Citizens’ Lives And Security, Transparent Dissemination Of Information, Accountability, Prevention Of Abuse Of Emergency Situations, Cooperation With International Institutions And Civil Society, And The Provision Of Remedies And Compensation After The Crisis. Furthermore, Fundamental And Non-Derogable Rights, Including The Right To Life, Prohibition Of Torture, Human Dignity, And Adherence To Fair Trial Principles, Must Not Be Violated Under Any Circumstances. Observance Of These Rights And Responsibilities Ensures The Protection Of Citizens, Reduces Damages, And Strengthens The Legitimacy Of State Actions During Times Of Crisis.
